1. Payment Processing Disclaimer

1.1 No Guarantee of Transaction Approval

An issuing bank, payment network or fraud engine may decline any transaction for reasons related to balances, limits or suspected fraud. While we use smart routing and multiple payment methods, we make no representation or warranty that every transaction will be approved, or that any particular payment method will be available at all times.

1.2 Changing Method Availability

The availability of a particular payment method (such as KNET, Mada or cards) may change without notice as banks and payment service providers update systems, experience outages or change policies. We accept no liability for periods during which a particular method is unavailable.

2. Merchant Responsibility for Legal Compliance

2.1 Compliance with Local Law

A1-PaymentGateway is provided as a tool for collecting and orchestrating electronic payments. A1-Soft does not encourage or condone any unlawful use of the Service. It is your sole responsibility to ensure that your business and products are lawful in your jurisdiction and to comply with all relevant laws and regulations, including the Payment Card Industry Data Security Standard (PCI-DSS).

2.2 Not Liable for Misuse

A1-Soft accepts no liability for any use of the Service that violates the applicable local law, the card-network rules or our Terms of Service. Any legal or financial consequences arising from your misuse of the Service, including chargebacks and penalties, rest solely with you.

3. No Guarantee Disclaimer

3.1 Service Availability

A1-Soft does not guarantee that the A1-PaymentGateway service will be available at all times or that it will operate without interruption, delay, or error. The Service may be subject to planned and unplanned downtime, including but not limited to:

• Scheduled maintenance windows for system updates and improvements.
• Unplanned outages caused by hardware failures, software bugs, or infrastructure issues.
• Service disruptions caused by third-party dependencies, such as hosting or network provider issues.
• Network interruptions, distributed denial-of-service (DDoS) attacks, or other cyber threats.

3.2 Performance and Processing Times

We do not guarantee any particular response time, processing speed, or settlement time. Payment-processing performance depends on numerous factors outside our control, including the responsiveness of banks and payment service providers, fraud-screening steps, and bank settlement timelines.

3.3 Compatibility

We do not guarantee that the A1-PaymentGateway integration will be compatible with every website platform, system, or configuration. While we strive to support a wide range of environments through hosted checkout, the SDK and the API, compatibility issues may arise. It is your responsibility to verify that the Service works correctly in your environment.

4. Limitation of Liability

4.1 Exclusion of Damages

To the maximum extent permitted by applicable law, A1-Soft Company shall not be liable for any of the following, regardless of the theory of liability:

• Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages of any kind.
• Lost Profits: Loss of profits, revenue, business, or business opportunities.
• Loss of Processing: Any harm resulting from a declined transaction, an inability to process it, or a delay in its settlement.
• Reputation Damage: Damage to reputation, goodwill, or brand value.
• Third-Party Claims: Any claims made against you by third parties arising from or related to your use of the Service.

4.2 Applicability

The limitations of liability set forth in this section shall apply to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

5. Indemnification

You agree to indemnify, defend, and hold harmless A1-Soft Company, its officers, directors, employees, agents, and affiliates (the "Indemnified Parties") from and against any and all claims, losses, damages, and costs (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of or access to the A1-PaymentGateway service.
• Your violation of these Terms of Service, the Privacy Policy, or this Disclaimer.
• Your violation of any applicable law, regulation, or third-party rights.
• Any use of the Service in violation of the local law in your location.

6. Force Majeure

A1-Soft Company shall not be held liable or deemed in breach of these Terms for any failure or delay in performing its obligations if such failure or delay is caused by events beyond A1-Soft Company's reasonable control ("Force Majeure Events"), including but not limited to:

• Natural disasters, including earthquakes, floods, and hurricanes.
• Acts of war, armed conflict, terrorism, or civil unrest.
• Epidemics, pandemics, or public health emergencies.
• Government actions, laws, embargoes, sanctions, or internet-blocking orders.
• Power outages, internet outages, or telecommunications failures.
• Distributed denial-of-service (DDoS) attacks or other cyberattacks.
• Failures or policy changes by third-party providers, including hosting providers or payment processors.

In the event of a Force Majeure Event, A1-Soft Company's obligations shall be suspended for the duration of the event, and the time for performance shall be extended by a period equal to the duration of the event. We will make reasonable efforts to mitigate the impact and resume normal operations as soon as practicable.

7. Security Disclaimer

7.1 No Absolute Security Guarantee

While A1-PaymentGateway is PCI-DSS compliant and encrypts sensitive data in transit via A1SSL, it does not guarantee your complete security. No payment system is a substitute for sound security practices on the merchant's side. We do not guarantee that:

• The Service will be free from security vulnerabilities, bugs, or exploits.
• Your transactions will be immune from all forms of fraud or advanced threats.
• Using the gateway will protect you from malware, phishing, or misconfiguration on your own site.

7.2 Shared Security Responsibility

Security is a shared responsibility. We are responsible for securing the A1-PaymentGateway infrastructure. You are responsible for maintaining the security of your account credentials and API keys, keeping your site and servers secured and updated, not storing cardholder data yourself, and not relying on the gateway as your sole security measure.

7.3 Vulnerability Disclosure

If you discover a security vulnerability in the A1-PaymentGateway service, we encourage you to report it responsibly to it@a1-soft.com. We will investigate all reported vulnerabilities and take appropriate corrective action.

8. Third-Party Disclaimer

8.1 Third-Party Services

The A1-PaymentGateway service depends upon third-party services. A1-Soft Company is not responsible for and disclaims all liability related to:

• Banks & Payment Networks: Approval or decline decisions, limits, or settlement timelines at issuing banks and payment networks.
• Payment Service Providers: Payment processing, billing disputes, chargebacks, or transaction failures at local and global payment service providers.
• Hosting Providers: Server availability, performance, or configuration issues at our infrastructure providers.

8.2 Third-Party Links and Content

The Service may contain links to third-party websites or resources. These links are provided for convenience only and do not imply endorsement or responsibility by A1-Soft Company for their content, accuracy, or practices. You access and use third-party resources at your own risk.
